MULCAHY LAW FIRM, P.C. provides classes and seminars for both board members and managers (free of charge) to ensure that they obtain and develop essential skills, develop a knowledge base and stay current with cutting edge information about community associations. This class will teach you all about strategic planning for your association including reserve studies, amending CCRs, analyzing finances, budget and how to accomplish the Board’s goals using the Eisenhower Method. 2/4- 1:00- 3:00 p.m.- HOT TOPIC: Short-Term Rentals in a Tourist Destination City – Friend or Foe?

A quick scan of online vacation rental websites in Arizona indicates that many owners want to rent their lots/units as a short-term rental. What are the pros/cons of short-term rentals in an association? What does Arizona law state regarding short term rentals? What rights does an owner have to rent a lot/unit as a short-term rental? Can an association’s board prohibit short-term rentals? Is a short-term rental considered operating a “business” within an association? Can an association’s board require that short term rentals be at least 30 days (or more) via a rule change? What are the rights and legal remedies of an association and neighbors when short term rental tenants don’t follow association rules? This “hot topic” class will address all of these questions and more! What is the importance of leadership? Strong leadership gives and organization guidance, stability, continuity from year to year and a unity of purpose. This class will discuss the many characteristics of a great community association leader. You will learn how a reserve study is organized, reasons for establishing a reserve study, how much money should be reserved, what should and should not be covered in a reserve study, how to reserve and what a reserve study costs.

2/28- 6:00- 8:00 p.m.- Amending Association Documents, filing taxes and dissolving HOAs

Do your association’s CC&Rs and bylaws contain unclear or contradictory language; developer language long after the developer is gone and/or provisions that conflict with Arizona and federal law? If you answered yes to one of these questions, your association’s documents may need to be amended. This class will teach an easy to follow 5-step process for amending association documents. You will also learn about bidding and contracting terms, how to request for bid, selecting the contractor, the importance of the contract and your recourse should something go wrong. This class will also discuss filing taxes for your HOA and dissolving HOAs.

Did you know that one of the most common mistakes an HOA or Condo makes is not following the Arizona Open Meeting Law? Regular sessions, executive sessions, owners wanting to tape the meetings, quorums, notice requirements, use of email for board votes, board participation via telephone or Skype, difficult owners at board meetings, emergency meetings ... this law can make your head spin!
