I know you are not expecting to read a ‘Legislative Update’ in the Summer, but I wanted to keep you aware of the status of a lawsuit that could impact recent legislation.

Last month, we informed you that a lawsuit was filed by Plaintiff David Russell asking the Court to void SB1482. The lawsuit alleges that SB1482 is unconstitutional.  I wanted to update you on the status of this lawsuit.  The case is still being litigated, and the Court has set a trial date of March 2, 2015.  It is important to know the case could get resolved before the trial date, but we will keep you updated as the lawsuit progresses.

SB1482 addresses many issues including how Association members can vote, as well as what information Associations can require from Owners renting their home.
